But that caution reflects the stakes involved.

A wrongly generated sentence, a fabricated legal citation, or a hallucinated case reference in a judicial order is not a minor bug — it is grounds for appeal, judicial misconduct proceedings, or a due-process violation, and several U. S. and international incidents of lawyers and even judges citing AI-hallucinated cases have already made this risk concrete and public.

The bench also carries the state's monopoly on legitimate coercive power exercised through law, and no jurisdiction has proposed transferring that authority to software. Judges are elected or appointed, not merely credentialed, adding a layer of democratic and political accountability that has no AI analogue. For all these reasons, the judiciary is one of the clearest examples of a role where courtroom procedure, legal authority, and public accountability — not just task complexity — keep the human decisively in charge.
