What a real estate agent actually does

Real estate agents represent buyers or sellers through the purchase or sale of a home, working under a licensed broker's supervision. A listing agent prices a property using comparable sales, advises a seller on staging and repairs, markets the home through photography and listings, negotiates offers, and manages the transaction through inspection, appraisal, and closing.

A buyer's agent tours homes with clients, helps them understand a local market's pricing and inventory, drafts and negotiates offers, and coordinates financing and closing deadlines. Both roles run on relationship-building and local market judgment as much as paperwork — knowing which comps actually apply to a specific street, reading a seller's real motivation in a negotiation, or knowing which inspector or lender to call when a deal is at risk of falling apart.

Every agent operates under a state real estate license and a legally binding fiduciary duty to their client, and since August 2024, federal antitrust litigation (the NAR settlement) has required agents to sign explicit buyer-representation agreements disclosing their compensation before showing homes, adding a new layer of required paperwork and client conversation to every transaction.

What the score misses is a real, personally-enforced fiduciary wall: every state imposes a fiduciary duty of loyalty, disclosure, and reasonable care on a licensed agent representing a client, and courts routinely impose personal liability — and license revocation — on agents for breach of fiduciary duty, negligent misrepresentation, or failing to disclose a known defect. That liability attaches to the individual license holder, not a platform.

There's also a directly relevant disconfirming case study: Zillow's own algorithmic home-buying business, Zillow Offers, shut down in November 2021 after losing hundreds of millions of dollars mispricing homes at scale — direct evidence that a purely algorithmic approach to real estate transactions struggled against the local, case-by-case judgment human agents provide. National Association of Realtors membership has fallen roughly 19% from its October 2022 peak (1. 6 million) to around 1.

3 million by late 2025, but every industry source attributes that decline to a slow housing market (high rates, low inventory) and the NAR commission-settlement fallout pushing out low-volume part-timers, not to AI displacement. Commission rates have held essentially flat — 5. 44% average in mid-2025, up slightly from 5. 32% the year before — despite predictions of AI-driven compression.
